Israeli Gantz could not be charged with sedition in Gaza: Dutch court | The Hague News

The Dutch Court of Appeals has approved a ruling against the Israeli security minister’s involvement in the 2014 Gaza assassination.

Israeli security chief Benny Gantz and a former military official have not been charged in connection with the case of a Palestinian Dutch man who lost six relatives in a 2014 plane crash in Gaza, a Dutch appellate court has ruled.

Ismail Ziada’s mother, three brothers, his brother-in-law, a teenage nephew and a friend were killed in the 2014 Israeli uprising in Gaza.

Globalization allows countries to prosecute serious crimes such as war crimes and torture regardless of their criminal record.

The extra case was dismissed by a Dutch lower court in January 2020, which ruled that the principles of international law could be applied to personal cases, but not to cases.

The lawsuit against Gantz and former army chief Amir Eshel could not go ahead because the men had “operational security,” the Hague Regional Court ruled at the time.

The Court of Appeal for The Hague ruled Tuesday that the lower court had ruled that Gantz, who was in charge of the army at the time of the attack, and that Eshel was safe because she followed the rules of the Israeli government.

“The Dutch courts are not qualified here to judge the case. The [lower] the court ruled in favor of the latter, ”states the Court of Appeal in The Hague.

“The top military has adhered to the principles of the Israeli government, which provides for their actions.”

The court further stated that it “does not recognize the suffering of the defendant.”

The lower court also ruled that Ziada had the right to prosecute Israelite men. In a case in 2019, Ziada rejected the notion that he could get justice in Israel as “worthless and cruel”.

At least 2,251 Palestinians, mostly civilians, and 74 Israelis, mostly soldiers, were killed in the attack.
